EMS Warranty and Complete Terms of Service Agreement

The terms and conditions set forth below shall constitute the expression of all the terms of this agreement as a complete and exclusive statement of the agreement between NETTwork Manufacturing Inc (hereafter referred to as SELLER) and the PURCHASER (hereafter referred to as BUYER)

Unless otherwise stated all terms and conditions herein shall be considered in effect upon you sending SELLER a Contract/Purchase Order.

TERMS OF PAYMENT Unless otherwise stated, all payments due Net 30. No discounts allowed.

TAXES SELLER does not include any sales, use or excise tax. If taxes are to be paid, the tax payment is the responsibility of the BUYER.

PENALTY FOR LATE PAYMENT A 1.5% late fee shall be assessed on any balances due past 30 days.

CANCELLATION CHARGES Additional charges will apply if an order is cancelled after production is started on said order.

DELIVERY Shipping dates are approximate and are based upon the date SELLER receives cast or electronically scanned data along with the necessary information with Purchase Order. Title to products passes to BUYER FOB point of shipment to BUYER.

The SELLER should not be liable for delays in delivery or in performance or failure to manufacture or deliver, due to causes beyond its reasonable control.

SHIPPING DAMAGE Responsibility for the product is transferred to the BUYER upon departure of the apparatus from our facility. As such, the BUYER is responsible for damage or loss of goods in transit. Therefore, it is recommended that the BUYER carefully examine the apparatus before accepting delivery from the carrier. In the event of loss or damage, the BUYER shall note said loss or damage on the transaction receipt and immediately file a claim with the carrier.

CONFIDENTIALITY The purchase of the Goods or Products does not entitle BUYER to employ the same with any design developed (in part or whole) by SELLER or others. Any/all design concepts or products are the property of the SELLER and are not for distribution to other parties or individuals.

WARRANTY The EMS Multi-Surfaced Inner Flexible Socket is the most reliable way to ensure a patient’s prosthetic limb remains securely in place. While our proprietary material and manufacturing process has proven to produce durable inner sockets second to none, we understand that sometimes things happen. Every EMS inner socket comes with a six-month warranty which begins the day our order ships. The EMS Patented Custom Liner comes with a 30-day replacement warranty which begins the day our order ships.

If you (patient or prosthetist) suspect a material failure or fabrication defect, call us immediately at (855) 654-0858.

You may be asked to provide the following: purchase order number, serial number, date suspected defect was observed, and photos. Once the warranty exchange is approved, you will be shipped a replacement EMS Socket along with a return shipping label to send us the defective socket.

DISPUTES Disputed portions or additional change order charges shall not be cause for nonpayment or delayed payment of any undisputed portion of an invoice which is due within 30 days from the invoice date.

GOVERNING LAW The laws of the State of Minnesota shall govern the validity, performance, interpretation and the effect of this agreement.

REQUIRED DISCLOSURE INFORMATION BUYER to provide Name, Address and Phone Numbers for evidence of adequate finances for initial order and Change Orders, authorized signer who represents the BUYER/Owner to sign off on Change Orders. Should the BUYER be adjudged bankrupt or insolvent in any legal proceedings, the SELLER shall have the right at its election and throughout the period allowed in such proceeding for filing claims against the BUYER’S estate, to cancel the order and to recover its proper cancellation charges from BUYER.

Below is a step by step demonstration on casting your patients for the EMS Socket System.

When is a patient ready for the EMS Socket System?

  • Limb size stable / decrease in volume changes
  • Patient understands how to take care of their limb and prosthesis
  • Patient has been in an elevated vacuum for 1-3 months (Post Pin System)

 

Can I just send you a test socket for you to create a mold from?

Yes; however, we do prefer that the Prosthetist cast the patient. Wrap the upper part of the condyles and the knee while the patient is in the test socket and mark the patellar tendon line. Send it to us and we’ll produce an amazing result.
 

Notes on Definitive Socket lamination:

 
1. A light but strong lamination such as carbon and epoxy resin suited to patient weight and activity level. Remember you have an I beam effect with inner & outer socket.
2. Trimlines on a standard socket height would be: 3/8″ below inner socket (anterior and posterior).
3. Medial and lateral sides should start at apex of medial condyle.
4. These lines should gracefully flow into anterior and posterior trimlines 3/8″ below flexible inner socket. We strongly recommend inner socket trim lines not exceed 3/8″ above definitive posterior trim line.
5. Posterior trim should always be the shape of a W. Medial hamstring with slightly deeper lateral hamstring.
6. The inner flexible socket will yield to hamstring pressure so donʼt lower much.

Why Trust The EMS Socket System?

Other socket systems are rigid and non-dynamic, therefore unable to accommodate volume changes that naturally occur throughout the day. These systems use compression and pressure to hold the prosthetic in place, increasing potential for discomfort during volume changes.

The EMS System corrects this issue using increased surface area and friction coefficiency to create negative pressure and flexible load distribution, allowing  the patient to comfortably maintain volume. Combined with its other features, the EMS provides amputees with a consistent and reliable connection.

With an inferior system, something as simple as sitting can be uncomfortable for an amputee. By balancing fluid changes within tissue, decreasing moisture accumulation around the skin, and accommodating for muscle movement, the EMS can provide ease, movement and freedom that other systems may not be able to.
